Terms & Conditions

By submitting your testimonial to THE Dispensary, you agree to the following Terms and Conditions:

1. Consent to Use

By submitting your costume photo, you grant THE Dispensary and its affiliates a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, reproduce, edit, publish, distribute, and display your testimonial in any form, media, or technology, whether now known or hereafter developed, without further consent from or compensation to you.

2. Content Ownership

You represent and warrant that you are the sole owner of the content submitted in the contest, or that you have obtained all necessary permissions and rights from the rightful owners to grant THE Dispensary the rights outlined in these Terms and Conditions.​

3. Right to Edit

THE Dispensary reserves the right to edit, condense, or modify your submission for clarity, brevity, and to remove any offensive or inappropriate content without altering the original intent or message.

4. Attribution

THE Dispensary may, at its sole discretion, attribute your costume submission to you by using your first name, initials, or any other identifier you provide. If you do not wish to have your name or other identifying information used, please indicate this in your submission.
 

5. Confidentiality

Please do not include any confidential or sensitive information in your submission. THE Dispensary will not be responsible for maintaining the confidentiality of any information you include in your content if it includes anything sensitive.

6. Gift Card Selection

THE Dispensary may, at its discretion, select which costume is the winner to receive a gift card as a token of appreciation. The selection process and criteria are at the sole discretion of THE Dispensary. Selection for a gift card does not alter the rights granted to THE Dispensary under these Terms and Conditions.

7. No Guaranteed Compensation

You acknowledge and agree that submission of a costume photo does not guarantee that you will receive a gift card or any other compensation. Gift cards are awarded solely at THE Dispensary's discretion.

8. Indemnification

You agree to indemnify, defend, and hold harmless THE Dispensary, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with your costume photo submission or any breach of these Terms and Conditions.

9. Changes to Terms

THE Dispensary reserves the right to modify these Terms and Conditions at any time without prior notice. Your continued submission or use of costume media after any changes constitutes your acceptance of the new terms.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Wisconsin, Virginia, Pennsylvania, North Carolina, and Ohio, without regard to its conflict of law principles.
